Albuquerque Police release video of officerinvolved shooting outside fast food restaurant

ALBUQUERQUE, N.M. (KRQE) – Albuquerque Police released new information and video from an officer-involved shooting in a McDonald's parking lot on Dec. 22.
Two officers shot at 32-year-old Roberto Perez as he was running away from them. Perez and another man, 35-year-old Joshua Garcia, were identified by police as suspects in a series of armed robberies that took place earlier that day.

With the help of APD’s license plate reader, police tracked the car the suspects were accused of using to an Autozone near Carlisle and Claremont around 4:30 p.m.
Commander Kyle Hartsock said the duo went into the store and when they exited, they ran from police in different directions. Garcia was arrested without incident while Perez was shot by officers in the left hand and back.
Police body camera video showed two officers running after Perez and yelling at him several times to drop the gun he had. Perez fell to the ground after being hit by the officer's bullets and was taken to the hospital to be treated. He was then released and booked into the Metropolitan Detention Center along with Garcia.
Albuquerque Police Chief Harold Medina said he believes the officers did not have enough time to use less lethal options while chasing after Perez. "It's really likely that it's going to be deemed that it was unfeasible for them to have less lethal available at that time," Media said at a press conference Wednesday.
Hartsock said investigators recovered five police casings from the scene: two of which hit Perez, one hit a parked vehicle, and the remaining ones did not leave a trace of a path.
Officers also recovered a handgun that Perez dropped when he fell to the ground. The gun had 10 rounds in the magazine but the chamber was empty. Hartsock said it was purchased in 2004 and police are working to determine who owned it.
APD said the officers involved in the shooting included one undercover officer who was hired in 2009 and has been involved in four prior shootings. The second officer was a part of the SWAT team, was hired in 2017, and has no prior shootings. Both have returned back to duty.
The shooting is still under investigation.
Before being confronted by officers, Perez and Garcia allegedly robbed a Circle K and Verizon store at gunpoint. In each incident, police said the two men left in a blue Hyundai sedan that matched the description of a vehicle that was reported stolen that morning.
Perez was charged with two counts of conspiracy to commit armed robbery, two counts of armed robbery, and resisting, evading, or obstructing an officer.
Garcia is charged with two counts of armed robbery, two counts of conspiracy to commit armed robbery, two counts of aggravated assault with a deadly weapon, receiving or transferring stolen motor vehicles, and resisting, evading, or obstructing an officer.
