ROCHESTER, N.Y. (WROC) - President Donald Trump has pardoned nearly all those convicted in the attack on the nation's Capital on Jan. 6, 2021. That includes Dominic Pezzola of Rochester, one of the Proud Boys who was sentenced to 10 years in prison for destruction of federal property and assaulting federal officers among other crimes. During the insurrection, Pezzola stole a riot shield and broke one of the windows of the Capitol building, making an entry point for rioters. The attack was part of an attempt to keep Trump in power after he lost the 2020 election. As of Jan. 20, most sentenced for their involvement that day are able to walk free. Four local men were included in Pres. Trump's pardons. Pezzola's sentence was commuted, which means the conviction still stands despite his ability to be released. "The pardon, I think, is Trump's way of trying to give everyone a clean slate. The President is authorized to do that, presumed it's the constitution to grant full pardons. I believe there were 1,500 pardons and six commutations. Commutations are different than a pardon. The conviction remains, but the stigma associated with the conviction remains. Still, you're basically removed from prison," said Sean Timmons, managing partner at Tully Rinckey PLLC. The actions to pardon those involved on Jan. 6 were among Trump's first promises upon taking office. "I believe the President expanded the scope to include just about everybody. That was a surprise to some extent, but it wasn't entirely shocking because it's consistent with the President's campaign promise to release everyone," said Timmons. Pezzola's sentence of 10 years in September 2023 was less than half of the 20 years prosecutors had argued for. Timmons also explained the process of those pardoned, including Pezzola, who will re-enter society. "I don't think Pezzola will be able to work in a corporate suite any time soon. I think corporate America would disavow any of the individuals who were pardoned pretty strongly. There's always jobs available for somebody," he said. The defendants pardoned are expected to be released from prison by the end of this week. News 8 reached out to members of Pezzola's family Tuesday, whom were not available for comment.
