Independence councilmembers vote to change rental and tenant landlord codes

INDEPENDENCE, Mo. — Indpendence City Council members unanimously approved amendments to an ordinance that hasn't been touched in eight years.

"It's a historic event. Essentially it's a win for tenants across the entirety of Independence and hopefully will lead suit for other counties and places to do it as well," Elliot West with KC Tenants said.
Key takeaways from the new amendments include updating the compliant process for tenants, updating inspection requirements and making sure furnaces, AC units and water heaters are working correctly.
One new requirement is in place because of a child's death this past summmer. A three-year-old fell nine stories from an apartment window at Independence Towers. While the boy's father and mother are awaiting trial in his death, the incident further fueled complaints about the building's poor conditions.
"We added a piece to put in window stops on the second floor and above windows so that those windows could have stops so that children would not fall out," councilmember Jared Fears said.
Landlords like Mark Yanda agree with the majority of the ordinance, but some of the language could present challenges in the future, and more time would've been nice to discuss the continents of the ordinance.

"I think from here, it gives the opportunity to discuss points that we weren't so clear on and they've offered that discussion to us. We are not closed out of it," Yanda said.
Councilmember Fears says most of the provisions will go into effect this May.
