PROVIDENCE, R.I. (WPRI) — For two local men whose Jan. 6 criminal cases haven't been adjudicated — it paid to wait. Federal prosecutors in Washington filed a motion to dismiss in the criminal case against Timothy Desjardins, of Providence, and Michael St. Pierre, of Swansea, following President Donald Trump's executive order of clemency on Monday. "The government hereby moves to dismiss the indictment against the defendant with prejudice," U.S. Attorney Edward Martin's office wrote in the filing Tuesday. "The government cites to the Executive Order dated January 20, 2025, 'Granting Pardons and Commutation of Sentences for Certain Offenses Relating to the Events at Or Near the United States Capitol on January 6, 2021,' as the reason for this dismissal." "With prejudice" means the government cannot bring the charges again. St. Pierre was scheduled to be sentenced in March after a judge convicted him for taking part in the attack on the U.S. Capitol in 2021. Desjardins' federal case has largely been on hold because he was facing a separate criminal case in Rhode Island for shooting someone in a road-rage incident. Desjardins was sentenced to 18 years in that case (his state conviction is not affected by the presidential pardon in the Jan. 6 case). Three other Rhode Islanders were charged and convicted in the wake of the riot investigations. Bernard Joseph Sirr, of North Kingstown, served two months in prison after he pleaded guilty. Timothy Cotton, of Hopkinton, was given nine months of probation. Juan Rodriguez, of Central Falls, was sentenced to one month. Chase Allen, of Seekonk, pleaded guilty in 2023 to “violent entry and disorderly conduct.” Investigators said he stomped on media equipment that day. He was sentenced to three years of probation. The presidential pardon was issued as "full, complete, and unconditional," which means the records of those charged or convicted will be wiped clean.
