FRESNO, Calif. (KSEE/KGPE) – The second presidential inauguration of Donald Trump took place Monday morning, and minutes after taking office, administrative officials shut down the CBP One app, a mobile app for migrants to make appointments at the U.S./Mexico border. A series of immigration executive actions are underway, fulfilling vows made by Trump on the campaign trail and reaffirmed in his inaugural speech. One such measure is declaring a national emergency at the border - this action will enable the U.S. Armed Forces to complete the border wall and deploy military troops. "Sending troops to the border isn't an entirely new thing, especially to help with things like processing of migrants who are entering," said George Rios, an immigration attorney at Cook & Olson. Rios agrees that the immigration system is broken but questions the necessity of declaring a national emergency noting that illegal immigrant crossings have decreased. "As far as is it an ongoing active emergency right now, personally not in the way that Trump would describe it, I wouldn't say it's an invasion of our country," he said.  Trump would also like to reinstate his Remain in Mexico policy, which requires migrants to stay in Mexico while they go through their immigration proceedings; however, Mexico would need to agree. Trump also designated Mexican cartels as foreign terrorist organizations. Rios explains that designating the cartels as terrorists might provide him with a new defense to help migrants seeking asylum. "As an attorney, I might be able to now make a claim that this is they're not just fleeing general crime, this is not just general quiet crime, because even our own government is now designated these people or these organizations as terrorist organizations," he said. For years, Trump has pledged to revoke birthright citizenship, which is enshrined in the 14th Amendment. That would have to be done through Congress or the courts; it cannot be done by executive order.
