Lawsuit filed over deadly BPD crash on S Union Ave

BAKERSFIELD, Calif. (KGET) -- A lawsuit has been filed over the death of a man struck by a Bakersfield Police Department vehicle on South Union Avenue last year.
The suit alleges negligence on the part of police in the crash that killed Brandon Elliott Gabriel Flores, 27.
It also alleges the city failed to keep the roadway safe. It says the area where Flores was hit "was dark, wide, had high vehicle traffic, had high pedestrian traffic, was known for vehicles driving at a high rate of speed" and didn't have a crosswalk nearby.
The suit was filed in December by Los Angeles-based Law Offices of Larry Rabineau on behalf of Flores' 4-year-old daughter and her guardian. A dollar amount wasn't attached.
A hearing on the matter is scheduled April 4.
Police say Flores was hit around 3:30 a.m. on June 17 near the 1500 block of South Union Avenue by a patrol car driven by Officer Julian Garcia.
Garcia and Officer Zachary Ward, the vehicle’s other occupant, were headed to a report of an auto theft in progress downtown. The vehicle's emergency lights and siren were not activated.
