New Mexico Supreme Court upholds community solar project rule

NEW MEXICO (KRQE) – The New Mexico Supreme Court has upheld a rule on community solar projects. PNM, Southwestern Public Service Co., and El Paso Electric challenged a Public Regulation Commission rule adopted in 2022 that allowed renters, small businesses, and other customers to buy electricity from local energy projects through a subscription. Subscribers then would get credit on their bills.

The utilities argued that the system wrongly barred them from charging transmission costs. The court disagreed, saying that practice is reasonable under the PRC's authority.
