Hawaii AG looks to crack down on illegal vape sales

HONOLULU (KHON2) -- More than 800 Hawaii tobacco retailers and distributors are being warned by Hawaii's Attorney General for selling illegal tobacco products, including vapes and oral tobacco pouch products.

A bipartisan coalition of 10 attorneys general nationwide is leading efforts to "hold companies accountable for unlawfully manufacturing, distributing, selling and marketing these products.
City Council eyes firework crack down
Attorney General Anne Lopez issued letters to Hawaii retailers and distributors to ensure only FDA-authorized e-cigarettes and oral nicotine products are sold in Hawaii.
Officials said some flavored disposable e-cigarette products are "largely manufactured and imported illegally into the United States from China."
The companies that produce these products declined to participate in the FDA-mandated marketing order process, marking the product adulterated and unlawful for sale.
These illegal products may contain dangerous ingredients not listed on the packaging. E-cigarettes typically contain lithium-ion batteries that have been linked to burns and explosion-related injuries. The Department of the Attorney General is recommending all retailers and distributors in Hawaiʻi to remove any tobacco products not authorized for sale by the FDA

Lopez also reminds distributors that e-cigarettes and e-liquids are included in the Cigarette and Tobacco Tax Law, therefore all wholesalers and dealers must have a tobacco license from the Hawaiʻi Department of Taxation to sell them.
Those aware they are distributing illegal tobacco products could face federal investigations and penalties.
