MANDAN, ND (KXNET) — Mandan Parks and Recreation has entered a settlement with the U.S. Attorney's Office after its Starion Sports Complex was found to be in violation of the Americans with Disabilities Act (ADA) of 1990. The Starion, which opened in 2017, is an 84,000 square foot facility featuring two ice rinks, a gymnastics center, parks maintenance shop, rubberized track and jumping facilities, practice field and track and field throwing facilities, and a synthetic turf football and soccer field. The U.S. Attorney's Office found that the complex was not fully accessible to people with disabilities. The investigation found that the complex did not have an accessible path to visitor seating in the football field, and that the accessible seating in the competition ice rink was "not an integrated part of the seating plan." The investigation also found a lack of accessible seating in other parts of the complex, and that parts of the bathrooms, concourse, skate rental counter, outdoor picnic area, and assistive listening systems did not comply with requirements. John Deere sued by FTC over ‘unfair’ equipment repair practices Under the settlement agreement, Mandan Parks and Recreation will have to fix all of these issues. “Protecting access for individuals with disabilities is a priority for the United States Attorney’s Office,” said U.S. Attorney Mac Schneider. “Mandan Parks and Recreation cooperated throughout this investigation, and I commend its commitment to quickly address the ADA violations when these barriers to accessibility were brought to its attention. The Starion is a great venue, and this settlement will help ensure everyone is able to access it.” Federal law prohibits discrimination by a public entity like Mandan Parks and Recreation on the basis of disability. Newly constructed buildings are required to comply with the ADA's requirements and be accessible to people with disabilities, including those who use wheelchairs.
