FOND DU LAC, Wis. (WFRV) - A 48-year-old man was found guilty on Thursday after pleading no contest stemming from a 2021 fentanyl overdose in Fond du Lac. A release from Fond du Lac County District Attorney Eric Toney states that Michael J. Kimmons pleaded no contest to First Degree Reckless Homicide on January 16. Kimmons' conviction stems from a fentanyl overdose on January 5, 2021. According to a criminal complaint, the victim was reportedly found dead inside a Fond du Lac residence. The Autopsy Protocol Report listed the cause of death as Cocaine and Fentanyl toxicity. Judge Douglas Edelstein ordered a pre-sentence investigation report and scheduled the sentencing hearing for March 28, 2025, at 11:00 a.m. "The Fond du Lac Police Department performed an excellent investigation that has helped take another drug dealer off the streets," said Toney. "We look forward to the sentencing hearing for the defendant to be held accountable and for the victim’s family and friends to receive justice." This case was investigated by the City of Fond du Lac Police Department and prosecuted by District Attorney Eric Toney.
