Driver charged with OWI in lifethreatening crash on US 27; BAC more than twice the legal limit

ALLEN COUNTY, Ind. (WANE) — Months after a crash in southern Allen County left a man with life-threatening injuries, the driver of the other car has been charged.
Joey Miser, 45, faces a charge of operating while intoxicated causing serious bodily injury, according to Allen Superior Court documents filed Thursday.
And those court records show his blood-alcohol level was nearly two and a half times the legal limit.
On July 3, 2024, Miser's car collided with the victim's on US 27 at the intersection with Ferguson Road. Police spoke with several witnesses to figure out who had the right of way.
The victim suffered a brain bleed and torn ligaments in his leg, court documents said.
According to court documents, Miser was unconscious after the crash, so a chemical test couldn't be done until hours later at the hospital, where it was revealed his blood-alcohol content was 0.208%.
Court records show an empty bottle of Smirnoff vodka was found in the car.
Miser was also convicted of an OWI in 2023 and was in community corrections when the next crash occurred less than two years later.
