WICHITA, Kan. (KSNW) - Wednesday night, the Wichita Ethics Board revisited the complaint against Mayor Lily Wu. The board discussed a revised report in the case. It centers on Firefighter Union President Ted Bush's allegations, claiming Mayor Wu told Fire Chief Tammy Snow to lay off 42 employees, violating the ethics code. Mayor Wu told the board that the evidence shows she never told Chief Snow to lay off employees. The board found Bush's allegations were conflicting and that Mayor Wu did not violate the ethics code. Both Mayor Wu and Bush sent the Ethics Board's responses to the original report. In Mayor Wu's response, she said she saw no conflicts in the facts and wanted the report amended or clarified. In Bush's response, he raised concerns regarding the audio recording not being taken as fact and his frustration with his complaint being labeled as "frivolous," a "waste of time," and "childish." He also informed the board that he received a letter from Mayor Wu's lawyer. Final determination The Ethics Board made its final determination on Wednesday. "The Ethics Board, having met in executive session to consider legal advice and then in open session, affirms its decision made December 3, 2024," read the ruling. The board stated the following reasons for its ruling: The Mayor notes that Bush's description of some statements made in the recorded conversation are not entirely consistent, of which the Board was generally aware. Within the recording is Chief Snow's statement "[t]hat's what I told her. I said look, I said I can do whatever you tell me to do because she came in, and she goes, 'you need to lay off the 42 firefighters from the SAFER Grant."' In her interview with the Ethics investigator, when asked about that statement, Chief Snow said she misspoke or overstated what she told Bush that the Mayor had said. The investigation did not support a finding of a Code of Ethics violation, and the Board thus found that none occurred. The notion that others may have concluded the Complaint was "frivolous," a "waste of time," or "childish" did not influence the Board's conclusions. The Ethics Board takes no position on such comments. The letter Mr. Bush indicates he received prior to the conclusion of this official process from Mayor Wu's attorney was sent after the events that were the subject of this complaint and was not reviewed as part of this appeal. As part of the original investigation, the Ethics Officer listened to Mr. Bush's entire 47-minute audio recording of the meeting between the Chief and Mr. Bush. The Ethics Officer determined that the four-minute clip was not taken out of context and that the remaining portions of the recording were not relevant to the investigation. The Mayor's appeal to the Board with possible document preservation language will not be addressed in this decision. The Ethics Board has carefully considered the assertions made by the Complainant and Respondent. The original decision of the Ethics Board set forth above is hereby affirmed.
