Henry Najdeski's estate receives $700K from City of Fort Wayne through tort claim

FORT WAYNE, Ind. (WANE) -- The family of Henry Najdeski received a $700,000 settlement from the City of Fort Wayne after a police officer struck and killed him with a vehicle while he crossed a downtown street.
The February payment was discovered by WANE 15 in an examination of city expenses for 2024.
A spokesperson with the City of Fort Wayne confirmed to WANE 15 that the city issued the settlement as a result of a tort claim filed by Najdeski's estate. In Indiana, $700,000 is the maximum amount that can be issued by a municipality through a tort claim.
"The city determined, after a thorough investigation of all relevant facts in this matter, that the payment made to the estate served the best interests of both the estate and the city," read part of a statement from the City of Fort Wayne.
The claim is connected to the death of Najdeski, who died in April 2023 after being struck and killed by a Fort Wayne police officer driving an unmarked pickup truck.
No criminal charges for officer who struck, killed pedestrian
In August 2023, the Allen County Prosecutor's Office ruled that the officer involved in the crash, Sgt. Joshua Hartup, would not face any criminal charges.
According to documents filed Dec. 20, months after the city had made its payment, Najdeski's wife, who served as executor of the estate, issued a closing statement in court saying all assets of the estate have been "collected" and "distributed."
