No deal reached in case of boy, 13, charged with murder; trial date set

BAKERSFIELD, Calif. (KGET) -- A plea deal has not been reached in the case of a boy who was 13 when charged with murder in a deadly shooting last year, and a trial is set for March.
Prosecutors extended a plea offer more than a week ago, but the attorney representing Dylan Fermin Flores said during a hearing in juvenile court Wednesday that they couldn't come to an agreement.
Judge Marcus Cuper scheduled a trial date of March 3 and ordered several witnesses present at Wednesday's hearing to return on that date.
Flores and Lance Burnett, 18, were arrested in the Oct. 27 shooting death of Ryan Dwayne Kephart in a field near South Washington Street and East Belle Terrace.
Police said the teens started a fight with Kephart, who was homeless. Kephart defended himself with a tree branch.

Burnett went home and retrieved a gun while Flores, armed with a knife, made sure Kephart didn’t leave, according to court documents. When Burnett returned, they chased Kephart and Burnett shot and killed him, documents said.
Due to his age, Flores can be kept in custody at most until his 25th birthday.
Burnett is charged as an adult with first-degree murder and has a preliminary hearing scheduled Jan. 30. He faces a life term in prison if convicted.
