BAKERSFIELD, Calif. (KGET) -- Greenfield Union School District is trying to get one trustee removed from it's board after the county mistakenly allowed over 100 voters who didn't live in the trustee area to cast ballots. Mercy Pena beat Ricardo Herrera by just eight votes in the race, and the county elections division admitted that 57 ballots were cast by invalid voters. The county and the school district have been working together to get a court ordered special election, and after a month of court filings, both were in court last Tuesday. Greenfield Union School district oversees 13 schools and 9,000 students. The county confirmed the special election would cost $20,000 or more, as the lawsuit is asking for the county to cover the district's legal expenses. The petition filed by the district and one affected voter, Jennifer Estrada, who happens to be the Ricardo Herrera's niece, calls for the November election to be voided and for a special election to be ran at the county's expense. If the election is annulled, Pena would lose her trustee seat, leaving it vacant. Pena declined to be interviewed but sent a release saying that nullifying the results doesn't benefit the voters. Luke Bryan’s 2025 Farm Tour making a stop in Shafter Herrera, however, says that Pena shouldn't have the seat and the county should be taking more responsibility. "I was upset that she, on her own accord, raised her right hand and be sworn in, when I think she should have waited to see the outcome of the court proceedings," said Herrera. "I think her argument has always been Aimee Espinoza certified the election on December the 5th…I have to be seated. But the outcome is uncertain." At the most recent court hearing, Pena argued the results should stand. Judge Bernard Barmann Jr. said he needed time to formulate a plan on how to go forward. The next court hearing is Tuesday morning.
