ROCHESTER, N.Y. (WROC) — David Porter, the man accused of shooting and killing a taxi driver, was found guilty on all charges Monday afternoon, by a Monroe County Jury. Closing arguments were delivered Monday morning and the jury only deliberated a couple hours before rendering its verdict. Porter pleaded not guilty to second-degree murder for the death of 45-year-old David Treese III last April. However, footage from Treese's dashboard camera on the day of the incident was played in court and three police officers testified — all on the second day of trial. In court on Monday, the prosecution argued Porter knew what the outcome was when he pointed a gun at someone's head and that just because he felt remorse, it doesn't mean he didn't intend to do it. Although the defense agreed Porter was guilty, they challenged the "intent" element. The defense argued that intoxication may not be a defense, but it should be considered as an element to the charges. Furthermore, the defense claimed Porter was a drug addict, hadn't eaten or slept for days, and had overdosed over 20 times. The prosecution maintained the defendant knew the outcome of his actions and did them anyway. Treese was found dead by police on April 22, 2024, with a gunshot wound. Investigators said Treese, a cab driver, was sent to First Street earlier that morning. He was then beaten with a handgun before he started driving. He was then shot multiple times, got out of the vehicle, and died from his injuries on Bay Street. Porter was accused of beating and shooting Treese before trying to drive away with the taxi cab. It was alleged Porter crashed the vehicle into a tree near Central Park before running away. On top of the murder charge, Porter was also charged with first-degree robbery and second-degree criminal possession of a weapon. Investigators said Porter had three prior felony convictions, three prior misdemeanor convictions, and had an outstanding warrant for arrest. The warrant, according to police, was for allegedly choking someone.
