(PALMER LAKE, Colo.) — Palmer Lake Mayor Glant Havenar posted an update on social media regarding the Buc-ee's annexation process that is currently underway, arguing that a previous Board of Trustees meeting was in compliance with Colorado statutes and reassuring locals that the decision whether the land is eligible to annex is only the first step in a long, detailed process. In the social media post, Mayor Havenar asserted that she and the Board of Trustees "will not be intimidated or threatened" by activist groups and would continue to attend to the annexation process "legally and with due diligence." Some locals had claimed that certain attendees were not allowed to speak, people were not allowed in due to capacity, and could not hear the meeting, and that the meeting was "unsafe" due to crowding. However, the Board addressed these claims, stating that staff ensured the capacity of the meeting was capped at a safe level, and said that all public comments that were submitted to the Board of Trustees were received. The Board added that a live stream of the meeting was provided to those outside as it was happening. "No one was prevented from speaking on the issue of eligibility," the Board said in the press release. The press release also addresses the proposal of a complaint being filed with the Colorado Attorney General, though the press release states that no such complaint has been received. FOX21 News reached out to Attorney General Phil Weiser's office concerning the alleged complaint, and received the following statement: This is a local zoning matter and there is no state law that authorizes the attorney general to intervene. Spokesperson for Attorney General's Office The press release reminded the community that the determination of eligibility for annexation was only the first step in a long process. "The Board intends to proceed in a prudent and fully informed manner, in full compliance with all applicable laws and regulations and undertaking some investigations that go beyond what is required by statute," the Board said. According to the Board, no decision on whether to officially annex the land has been made, and such a decision will not be made until all independent studies have been completed and all public input has been gathered. Three studies are being conducted on the possible annexation, which include: A study analyzing the fiscal impacts of the proposed annexation and development A study considering the ability of the Town's water rights and water system to support such a development and the public improvements that might be required A study to analyze the anticipated traffic impacts of the proposed development and roadway improvements that would be needed The results of these studies are not expected until February, the Board said, so no decisions will be made until those results are received and reviewed. "This process will also include negotiating an agreement with the developer setting forth the rights and obligations of the Town, and the developer, if the annexation is deemed to be beneficial to the Town," the Board said. "Finally, the process will include obtaining a clear understanding of what the proposed Buc-ee's development would look like before any annexation is agreed to."
