NEW ORLEANS (WGNO) — On behalf of the plaintiffs, New Orleans attorney Morris Bart is suing the City of New Orleans and its contractors for failing to prevent the New Year’s terror attack. Bart and his attorneys represent six survivors of the attack and the father of Brandon Taylor, who was killed. This marks the first lawsuit to be filed in Orleans Parish Civil District Court more than a week after the murderous attack. The defendants in the case include the civil engineering company Mott MacDonald, LLC., Hard Rock Construction, their insurers and the City of New Orleans. “Our investigation has revealed this responsibility of Mott MacDonald and their contractor, Hard Rock. Now, where the city fits into the picture, at this point, we're not quite sure,” explained Bart. New Orleans council investigating missing bollards ahead of Bourbon Street attack The longtime civil attorney says during a meeting this past April, Mott MacDonald informed the city that their bollard system needed to be replaced. “Mott MacDonald gives a terrorist scenario that involves someone driving a Ford F-150 truck down Canal Street, turning right on Bourbon Street, and then ramming into people going down the street,” The exact scenario happened eight months later when a Texas man, driving an F-150, plowed through the crowds on Bourbon Street in the early hours of New Year’s Day. The lawsuit states despite admitting that upgraded sidewalk bollards were needed, Mott MacDonald did not recommend a bollard system that would prevent a speeding vehicle from traveling onto the sidewalk. The engineers allegedly recommended a cheaper option that would protect from speeds below 12 miles per hour. Bart continued, “So, clearly, all the injuries, in my opinion, in the second and third block of Bourbon Street were preventable had the system been used, or when they did remove the bollards, the company that actually envisioned this terror scenario should have known to put in bollards in its place while they were doing the work.” Bart says he’s not concerned about the city receiving qualified immunity if a judge rules it as general negligence. NOPD officials talk Super Bowl, Mardi Gras safety He and his attorneys are now focused on the discovery phase of the case and preventing future attacks.  “Hopefully, this will bring about immediate change so that everybody can go in the French Quarter, everybody can enjoy themselves without looking over their shoulder and being afraid that something horrible like this can occur again,” said Bart. At this point, Bart says, they’re not sure if the New Orleans Police Department is at fault, which is why the department is not named in the lawsuit. WGNO reached out to the defendants. A spokeswoman for the city said their office doesn’t comment on pending litigation. WGNO has not heard back from Mott MacDonald nor Hard Rock Construction.
