ROCHESTER, N.Y. (WROC) — The trial continued Thursday for David Porter, a man accused of beating and fatally shooting a taxi cab driver in Rochester last April.
News 8 followed the trail Thursday. The day in court started with three Rochester police officers taking the witness stand. The officers detailed the night they responded to the scene.
I’m sitting in on day 2 of the trial for David Porter, accused of shooting and killing cab driver David Terese III on 4/22/24. 3 RPD officers have taken the witness stand so far this morning @News_8 https://t.co/JbxVgYdniS— Emalee Burkhard (@EmaleeBurkhard) January 9, 2025
Rochester police say when they got to Bay Street, they found a man unconscious and not breathing on the side of the road.
That man, identified as David Treese III, was working as a cab driver that night when he picked up Porter.
In court Thursday, video captured from a camera in Treese's windshield showed moments from the night of the incident. In it, you see Porter seemingly get in the car and immediately attack Treese, shoot him multiple times, and repeatedly hit him with the gun. When the video ends, Treese is covered in blood. He later died from his injuries.
Rochester police allege after the shooting, Porter drove away inside the taxi cab before crashing near Central Park and running away.
The prosecutors defending Porter had this to say after viewing the footage in the court room:
"It's nothing we weren't expecting. Again, this is all part of what our defense is going to be, in terms of what we believe our client was at the time this all happened, that he was intoxicated by drugs, under the influence of drugs, and acted that way," Defense Attorney Michael Schiano said.
Porter pleaded not guilty to first-degree murder in the death of David Treese III.
Furthermore, after the shooting, Porter was accused of driving away inside the taxi cab before crashing near Central Park and running away.
The trial is set to continue Friday with more witness statements, and closing arguments are expected Monday. Stay with News 8 for continuing coverage on this trial.
