TOPEKA (KSNT) - With much of the Capital City still blanketed in snow, when are property owners responsible for the cleanup? Topeka's Municipal Code shows that owners of residential, multifamily, commercial and non-residential properties must remove snow and ice from adjacent public sidewalks within 48 hours of a snow or ice event. The ordinance states it is unlawful to move snow onto a sidewalk, driveway, roof, alley, public street, street right-of-way, handicapped stall and public or private parking area. The city public works director has the authority to issue violations. For residential property, the first violation is $20 per violation. If a second or subsequent violation happens within 12 months another $50 fine is issued. For multifamily, commercial and nonresidential property, the first violation is $50 per violation. If a second or subsequent violation happens within 12 months another $100 fine is issued. "[If] said snow or ice constitutes a threat to public health and safety, the Public Works Director or his or her designee may cause all accumulation of snow or ice to be removed," the ordinance reads. "The costs of said snow or ice removal shall be charged to the owner of the real property." If ice accumulates to make the removal, sprinkling of sand, ash or other materials impossible within the timeframe, property owners are considered in compliance.
