WASHINGTON (NEXSTAR) - The House passed the Laken Riley Act Monday, 264 to 159, with 48 Democrats voting for it.  Congressman Mike Collins (R-Ga.) described the death of 22-year-old Georgia nursing student Laken Riley last February.  "She was just out for a jog, enjoying the day when an illegal criminal took her life away," Collins said.  The man convicted of killing her, Venezuelan migrant Jose Ibarra, was in the country illegally. He's now serving life in prison.  "This legislation could have prevented her death," Collins said.  The Laken Riley Act would require federal authorities to detain illegal immigrants arrested, charged or convicted of theft-related crimes.  "No due process at all," said Rep. Jamie Raskin (D-Md.)  Maryland Democratic Congressman Jamie Raskin says expanding the detention requirement to include those accused of theft could sweep up innocent people.  "This allows us to get up and demonize immigrants without doing anything to fix the immigration system," Raskin said.  Wisconsin Republican Congressman Derrick Van Orden says the government needs to first protect its citizens. He recounted crimes in his own state he says this bill could have prevented.  "None of this would have taken place if this person was detained and deported for a simple property crime. Enough," Van Orden said.  The bill also lets states sue federal agencies for failing to enforce immigration laws. Some Democrats argued states don't have standing to do that.  "This provision is almost certainly unconstitutional," Rep. Jerry Nadler (D-N.Y.) said.  The bill now heads to the Republican-controlled Senate, where Rep. Steve Scalise (R-La.) says he expects it will be voted on soon.  "John Thune wants to move that bill as early as this week," Scalise said.
