BAKERSFIELD, Calif. (KGET) -- The Kern County District Attorney's Office has extended a plea offer to a boy who was 13 when charged in connection with the shooting death of a man in October. The defense attorney representing Dylan Fermin Flores said during a hearing Monday that she needs time to discuss the offer with her client. ‘We’re trying to help out’: County officials effort for power in destroyed mobile home park The terms were not revealed in court. Due to his age, Flores can be kept in custody at most until his 25th birthday. Judge Marcus Cuper scheduled a follow-up hearing later this month. Flores and Lance Burnett, 18, were arrested in the Oct. 27 shooting death of Ryan Dwayne Kephart in a large field near South Washington Street and East Belle Terrace. Police said the teens started a fight with Kephart, who was homeless. Kephart defended himself with a tree branch. Never miss a story: Make KGET.com your homepage Burnett went home and retrieved a gun while Flores, armed with a knife, made sure Kephart didn't leave, according to court documents. Kephart tried to run, but they chased him and Burnett fired several times, killing him, Flores told police. Burnett is charged with first-degree murder and has a preliminary hearing scheduled Jan. 30 in Superior Court. He faces a life term in prison if convicted.
