Former Rio Arriba sheriff who went to prison sues Española Police Department

RIO ARRIBA COUNTY, N.M. (KRQE) – He's a former New Mexico Sheriff who served prison time for helping a felon and intimidating a witness. Now more than three years after his conviction, that sheriff is suing the police officers who investigated him claiming those officers violated his rights.

Española police arrested former Rio Arriba Sheriff James Lujan in May 2020, accusing the sheriff of getting in the way of an investigation. That case involved former Española city councilor Philip Chacon. In 2017, Sheriff Lujan helped Chacon hide from police, something Lujan was eventually convicted of.
Now, Lujan is suing the City of Española and some of its police officers, claiming they violated his civil rights. The lawsuit argues that when Española police showed up to Lujan's home with a search warrant in 2020, they disregarded his safety by firing six rounds into his door.
The lawsuit also claims Española police didn't read Lujan his Miranda Rights and that the sheriff was arrested due to "refusing to incriminate himself" and "requesting an attorney".
In lapel video, Lujan can be heard telling police officers, "I'm invoking my right to an attorney right now. Do you understand that?" The officer said “Okay. Take him and book him.” Lujan asked, “Book me for what?” and the officer replied, “For obstruction."
That case eventually led to Lujan being convicted by a jury and sentenced to three years in prison.
The lawsuit goes on to say that some of the police officers who testified during his trial lied and changed their testimony. Lujan argued that being sent to prison put him at risk of serious and immediate harm by exposing him to inmates he investigated and arrested.
KRQE News 13 reached out to Lujan's attorney multiple times this week for comment on the lawsuit but didn't hear back.
