NYS: Tips to help consumers navigate return and refund policies

ROCHESTER, N.Y. (WROC) – As the holiday season comes to a close, the New York Department of State's Division of Consumer Protection is providing tips to help consumers navigate return and refund policies.
With policies varying from store to store, making returns and refunds can become a challenge at times. State of Retail Returns 2024 Report states a $743 billion dollars' worth of merchandise returned in 2023.
In order to help people understand how to receive a refund, New York State law requires stores to post their refund policies on the item, at the store entrance or near a cash register. Retailers are also required to provide a written copy of the stores return policy when requested.
Despite these policies being set in place, New York State does not require retailers to accept returns, but they are required to post a notice visible to people before the point of sale if this is the case.
If a retailer does not post a return policy, the state requires retailers to accept unused, undamaged merchandise within 30 days of the purchase date.
Understanding refund terms is also important for consumers. New York State does not require a specific way for retailers to give refunds, but it does require a refund of cash, credit, or exchange and for the type of refund to be clearly disclosed before purchase.
It is also advised that you ask a retailer if a return fee is involved before purchasing anything, and to be sure to retain any proofs of purchase in case it is required.
