A 62-year-old Heber City man was arrested for obstruction of justice after he admitted to burying the gun he used to shoot Patrick Hayes, 61, on Sept. 25 near Jordanelle State Park, according to Wasatch County investigators.Wasatch County Sheriff’s Office deputies detained Greg Kyle DeBoer on Nov. 13 to question him about Hayes’ death, according to arresting documents. DeBoer allegedly admitted to the shooting — a road rage incident in which the driver of a Jeep Gladiator, registered to DeBoer, fatally shot Hayes near Ross Creek entrance and drove away from the scene  — and claimed “he acted in self-defense.”“Greg DeBoer admitted to shooting Patrick Hayes with his .45 caliber Kimber 1911 and admitted to burying the gun near his house sometime after the shooting. While investigators were questioning Greg DeBoer, a search warrant was served at his house,” the affidavit of probable cause stated.Wasatch County investigators found the gun buried in a case behind DeBoer’s home along with .45 caliber Black Talon ammunition. The ammunition matched the single .45 caliber bullet recovered from Hayes’ body by the State Medical Examiner’s Office.“The recovered bullet was a Winchester Black Talon, this is a bullet that has been out of production for at least 20 years and is therefore uncommon. Subsequent questioning of people who know Greg DeBoer revealed that he owns a Kimber 1911 .45 caliber handgun, which he frequently carries and that he also loads this gun with Winchester Black Talon ammunition,” arresting documents said.The Sheriff’s Office announced it recovered the firearm in late November.Deputies said there was enough probable cause to arrest DeBoer with obstruction of justice: acting to hinder, delay or prevent an investigation or apprehension when he buried the handgun and ammunition. He was arrested on Monday. DeBoer has not been charged with the death of Hayes. Camera footage from the Ross Creek gatehouse from the night he died shows a Jeep Gladiator pulling up behind Hayes around 11:09 p.m. as Hayes exited his vehicle. Video shows Hayes standing near the passenger side of the Jeep Gladiator when he was shot. Evidence found on the scene supports the recordings.The Sheriff’s Office is investigating whether Hayes attempted to enter DeBoer’s Jeep. Law enforcement said Hayes approached the vehicle with a metal baton and pocket knife in hand and “aggressively” called the other driver out of the vehicle.The driver of the Jeep Gladiator turned around and drove away after shots were fired, killing Hayes. There are no reports of shooting or other emergency calls to law enforcement. Hayes’ body was discovered the next morning by a person passing by, according to court documents.Tracking data obtained through search warrants showed DeBoer’s Jeep Gladiator connected to a cell tower that serves the Ross Creek gatehouse area. DeBoer’s vehicle was connected to the tower from 11:01 p.m. until 11:28 p.m. on Sept. 25. DeBoer lives less than 10 miles from the area, deputies learned.“Our investigators have consulted many times with Wasatch County prosecutors throughout the investigation and have submitted evidence to the State Crime Lab for analysis,” a November press release from the Sheriff’s Office said. “We anticipate this analysis, as well as electronic data analysis, to aid in determining the circumstances of the situation leading up to and resulting in the death of Mr. Hayes. We are fully investigating this matter for all possible crimes, including homicide, and considering all defenses, including self-defense.”The Fourth District Court ordered DeBoer to be held without bail. He faces a second-degree felony charge for obstruction of justice relating to an investigation involving conduct constituting a capital felony or first-degree felony.Hayes’ family said in a statement last month they do not believe the incident was self-defense.“There are many questions that we have but we will choose to wait until the County Attorney chooses the charges that will be sought to ask those. We believe in our hearts that this was an unjustified homicide, and we hope that the evidence and investigation proves that. We hope that the detectives will wrap up their investigation soon so that we may receive and pursue justice for Patrick.
