Delano PD: No evidence of excessive force in contact with gang member

BAKERSFIELD, Calif. (KGET) -- The Delano Police Department said it has found no evidence of excessive force during officers' contact with a gang member who was briefly detained over the weekend -- and warned against posting photos of officers and their families "with the intent to cause harm and or place those family members in fear for their safety."
The department, citing a state law that makes it a misdemeanor to use an electronic device to make a person fear for their safety or the safety of their family, said it will send the case to the District Attorney's Office to decide whether charges are warranted.
"It is not our intent to infringe upon anyone's First Amendment rights, but those rights should be exercised in a manner that is in accordance with the law," the department said in a release.
The incident leading to the posts occurred two weeks ago, police said, when an assault involving Norteno street gang members in the 400 block of Jefferson Street resulted in life-threatening injuries.
On Saturday night, police patrolling Jefferson Street contacted and detained a Norteno gang member who was on parole for robbery. Two other gang members ran.
The detained person cooperated with the police supervisor on scene and said he wasn't injured, police said. He was photographed -- no injuries were visible.
A few hours after his release, the gang member went to an emergency room and said he was in pain from the handcuffs and being hit in the face, police said.
A review found no assault occurred.
"Body-worn cameras, police reports, and two administrative interviews of the detained person have been reviewed, and the evidence reveals that the detainee was not struck with hands or feet, was not thrown to the ground, was not batoned, was not tasered, nor was he pepper-sprayed," according to police.
