Man serving 12year sentence for Monroe County assault dies after 'useofforce' at Marcy Correctional Facility: AG

ROCHESTER, N.Y. (WROC) -- 14 staff members allegedly involved in an "attack" at Marcy Correctional Facility that left an inmate dead are likely to be fired, according to a Saturday release from Governor Kathy Hochul. The inmate was serving a 12-year sentence for assaulting someone in Monroe County.
"Yesterday I directed DOCCS Commissioner Martuscello to immediately begin the termination process for 14 individuals who were involved in the fatal attack on an incarcerated individual at Marcy Correctional Facility. This action comes after I directed an internal review of the circumstances that lead to this individual's death. I once again offer my condolences to the deceased individual's family and loved ones," Hochul announced.
According to DOCCS officials, Robert Brooks, 43, was initially committed back in March of 2017. Attorney General Letitia James, whose office is also investigating this incident, said Brooks died Dec. 10, 2024 at the hospital following "an encounter with New York State Department of Corrections and Community Supervision (DOCCS) officers at Marcy Correctional Facility" the day before, adding that there was video evidence of the incident.
“Office of Special Investigation (OSI) has opened an investigation into the use of force by correction officers that preceded the death of Mr. Robert Brooks at Marcy Correctional Facility. As part of the ongoing investigation, OSI has obtained and is reviewing video of the incident. In accordance with our voluntary video release policy, we will make the footage available to the public after Mr. Brooks’ family has had the opportunity to view it. Law enforcement professionals must be held to the highest standards of accountability, and I am committed to providing New Yorkers with the transparency they deserve," James announced.
