No charges filed for officer in 2022 Fresno shooting, DOJ says

FRESNO, Calif. (KSEE/KGPE) - There will be no criminal charges filed against an officer who was involved in a shooting in Fresno that killed 27-year-old Austin Flores in May of 2022, the California Department of Justice announced Wednesday.
On May 19, 2022, at 11:22 a.m. officers from the Fresno Police Department's Central Policing District were dispatched to West Cortland Avenue for a call of a violation of a restraining order, police say.
According to officials, Flores' mother, who was the reporting party, advised dispatch that her son violated a restraining order and was in her backyard, inside a vehicle.
Police say she told dispatch that Flores had brandished a firearm and told her he was ready if the police came for him.
According to police, a perimeter was established around the house once they arrived. Police say Flores became aware of the police presence and fled the vehicle he was in and pointed what an officer believed to be a firearm at him. Officers then opened fire at Flores as he was holding the firearm.
The DOJ says the officer shot at Flores nine times. Police say Flores was taken to the hospital where he later died from his injuries.
Police say following the shooting, they determined that the firearm Flores had been holding during the incident was a replica gun.
The California Department of Justice is required to investigate all officer-involved shootings that meet the guidelines established in California Assembly Bill 1506.
In the released report from the state's DOJ on Wednesday it states that criminal charges were not appropriate in this case because the evidence is insufficient to prove that the officer committed a crime.
