BAKERSFIELD, Calif. (KGET) -- Investigators questioned family members after finding what appeared to be older bruising on a month-old boy who died after suffering skull fractures and bleeding on the brain. A woman -- her name is redacted but from the context she appears to be the child's mother -- told investigators she confronted the father, Eduardo Gutierrez Sr., a week earlier for pinching the baby, according to newly released reports authored by sheriff's investigators. "(Name redacted) said she did not report this incident because she loves her child's father, and she is in denial about him hurting her child," investigators wrote in the court filings. Gutierrez denied harming his son but acknowledged the baby was fine when the mother left him in his care. He couldn't explain the injuries. "I don't know what to tell you," Gutierrez told investigators. Gutierrez, 24, was arrested and charged with felony child cruelty. Prosecutors are seeking to add a charge of second-degree murder. He's due back in court Feb. 18. On Nov. 24, the baby, Valentin Gutierrez, was found limp and unresponsive by his mother, who’d taken a nap after leaving him in the care of Eduardo Gutierrez, according to court filings. She asked what happened. “I made him stop crying,” the mother said he told her according to the filings. She said he claimed the baby fell off the bed. Interviewed that day, Gutierrez told investigators he uses marijuana and methamphetamine. He said Valentin's mother had previously dropped the child when she fell asleep while trying to calm him. He and the mother have two children in common. His other child didn't cry much, Gutierrez told investigators. "But this one he always cries," Gutierrez said of Valentin according to the filings. Due to the severity of his injuries, Valentin was transferred to Valley Children's Hospital in Madera. He was pronounced dead Dec. 2. The baby suffered skull fractures, bleeding on the brain and bruising to his face, neck, rib cage and left knee and thigh, according to the filings.
