ROCHESTER, N.Y. (WROC) — A Rochester man pleaded not guilty after police said he called 911 and assaulted an officer.
Rochester police officers were called to the Delta Sonic on West Ridge Road around 4 p.m. Tuesday. The initial report was for a robbery, but they determined there was no robbery.
During the investigation, 37-year-old Brandon Volpe was accused of walking up to a uniformed officer, asking a question, and punching him in the face unprovoked. RPD said he continued to strike the officer before he was arrested.
The officer who was assaulted was taken to the hospital for facial injuries and was released.
Officers said they called the phone number that reported the robbery, and it led to Volpe's phone ringing. Investigators determined Volpe called 911 to lure the officers to the Delta Sonic in order to attack them.
Vole was charged with second-degree assault and third-degree falsely reporting an incident. He was taken to the Monroe County Jail. He pleaded not guilty to the charges.
Volpe's next court appearance will be on December 23 at 2 p.m.
