Ludlow proposes new tobacco rules for retailers

LUDLOW, Mass. (WWLP) - Ludlow's Board of Health is proposing revisions to its tobacco regulations--which could impact the sale of certain tobacco products in town.
A public meeting regarding the matter was canceled Tuesday night and postponed to January but 22News was still able to hear from the Health Director who says they want public input--especially from business owners, before they make any updates.
"We have 16 tobacco retailers within the town of Ludlow so their input is really important," says Paulina Matusik, Director of the Health Department. Ludlow's Health Board is looking to update its tobacco regulations, which were last revised in 2018.
The update would put the town in alignment with current state laws, and make amendments to local policy that could tighten tobacco restrictions. The sale of oral nicotine pouches is at the forefront. The board's latest draft of the regulations cites an increased use of oral nicotine pouches by high school students, as well as a spike in sales since 2018.

A proposed amendment would prohibit a retailer from selling these pouches with a nicotine content greater than six milligrams per pouch. It would also restrict the pouches to adult-only retail tobacco stores. However, this proposal has generated concern that these retailers are being singled out.
"We think those are all the wrong approach--- if the town wants to restrict wants to restrict 6mg per pouch--- it seems arbitrary," says Peter Brennan with the New England Convenience Store and Energy Marketers Association. "Our whole industry feels that there needs to be more common sense in these approaches."
A public hearing was postponed to January to discuss the proposed changes but the Health Department is hoping to find common ground with a retailer who could be impacted.
"We want to work with the retailers," Matusik adds. "We are not looking to make any changes that would negatively affect any of the businesses in town. Which is why we put the draft regulations together and hold the public hearings."
