(LAS ANIMAS COUNTY, Colo.) — A former Las Animas County Sheriff's Office deputy has pleaded guilty to one misdemeanor after being charged earlier this year over tasing a man in the face in 2022, according to court documents. The incident occurred in Nov. 2022, when Kenneth Espinoza and his son were driving separate cars. His son got pulled over by Lieutenant Henry Trujillo and Deputy Mikhail Noel for a traffic citation, and Espinoza also pulled over behind them to wait for his son. While waiting, Espinoza was approached by both deputies who told him to "get out of there" and after some back and forth, Espinoza decided to pull away to leave, but Noel changed his mind and began screaming at Espinoza to stay. In the body camera released in April 2023, Espinoza can be seen handcuffed, tased, and jabbed with a stun gun. “We’ve all seen the body camera. It speaks for itself. This was just totally unjustified. It was brutal. And that’s what this report says, that Ken had committed no law violation. That he had done absolutely nothing wrong,” said Kevin Mehr, Espinoza's attorney in a previous report. Originally Trujillo and Noel faced five misdemeanors including; Third-Degree Assault, Peace Officer Failure to Intervene, Official Misconduct, Official Oppression, and Menacing, which were all filed in July 2024. On Monday, Dec. 16, Noel pled guilty to a tampering charge, according to court documents. The rest of the charges he previously faced were dismissed by his plea. As for Trujillo, he is set to appear in court for a plea hearing on Thursday, Dec. 19. "A true miscarriage of justice," Mehr told FOX21 News when asked about the misdemeanor plea.
