CARMEL, Ind. — A Carmel man is facing charges after he reportedly dealt a man a fatal dose of fentanyl in December of 2022. Court documents indicate that officers with the Carmel Police Department were called to the 1200 block of S. Rangeline Rd on December 13, 2022, around 8:48 a.m. for a welfare check. Police said a 35-year-old man named Max Waples had not been in contact with relatives since two days prior and had not shown up to work on the 12th or 13th. CPD officers entered Waples's apartment and found him unresponsive in the kitchen. He was not breathing, had no pulse and was pronounced dead on the scene. Court documents added that detectives at the scene found Waples's driver's license, a red straw and the corner of a plastic bag with a brownish powdery substance on the kitchen island countertop. When CPD conducted a field test for this substance, they said a positive test result appeared for the presence of fentanyl. Later, Waples's cause of death was determined to be fentanyl intoxication. Court docs report that he had 22 ng/mL of fentanyl and 3.5 ng/mL of Norfentanyl (a metabolite of fentanyl) in his bloodwork. CPD spoke to one of Waples's relatives, who told police Waples left a lunch with them between noon and 1 p.m. and thought he was planning to go shopping. Shortly thereafter, officers obtained a search warrant for Waples's Lyft records. They discovered he had left his residence on December 11, 2022, and headed to the Keystone Mall. This is consistent with the fact that Waples's relative told officers he was heading to the mall to get a pair of Apple AirPods replaced. However, on his way home, Waples added a waypoint to his Lyft ride at the intersection of E 19th St. and Bellefontaine St., court documents indicate. Because Waples was reported to be on electronic monitoring through Hamilton County Community Corrections for a previous case, the corrections office provided a timeline of Waples' GPS movements. They discovered he was in or around a residence on the 1900 block of Bellefontaine St. Court documents show that Cynthia Hooks owned this house, per a check of the Marion County property card. However, Cynthia Hooks had filed an eviction notice on a 35-year-old Carmel man named Royce Hooks on December 13, 2022, at the residence's address. Detectives received a search warrant for Waples's Cash App and found that he sent $120 to Hooks on Dec. 11. According to court docs, police conducted a forensic search of Max's phone on June 14, 2023. Here, they uncovered a series of Snapchat conversations in which Waples communicated with an account later traced back to Hooks. Waples requested a "G", or grain, of fentanyl, and Hooks said he would supply the drug for $120. The investigation continued, and a case was filed against Hooks on Thursday. Now, Hooks is charged with dealing in a controlled substance resulting in death (Level 1 Felony). In Indiana, this has a maximum prison sentence of 40 years. A mugshot for Hooks has not been provided at this time.
