ADAMS COUNTY, Ind. -- Cockroaches. A pot on the stove containing mold and flies. Trash everywhere. These are just a few examples of the conditions police say led to the negligent death of a 2-year-old who was left alone in a closet alongside a space heater.
Sintia Perez, 21, and Jace Hirschy, 23, are facing several felony counts for their alleged roles in the death of their daughter in November. The pair has been preliminarily charged with neglect of a dependent resulting in death (level 1 felony) and two counts of neglect of a dependent (level 6 felony).
According to court documents filed on Dec. 2, law enforcement first came into contact with the couple around 3:26 p.m. on Nov. 27 when officers with the Berne Police Department responded to an apartment at the Swiss Meadows apartment complex.
The Allen County Coroner, Indiana Department of Child Services and the Adams County Sheriff's Office also responded to the call.
Court documents show Hirschy, the child's father, called the Adams County Sheriff's Office for medical assistance. As part of their investigation, an officer entered the apartment's main bedroom and checked out its closet.
Once inside the closet, the officer saw the couple's dead 2-year-old lying in a crib on a "very soiled" mattress as officers observed broken white paper plates on the floor and beneath the crib. Officers also observed what appeared to be feces stuck to the floor as they continued their investigation, according to court documents.
The officer also noted a "significant" difference between the heat levels in the small closet compared to one of the apartment's main bedrooms. Officers observed trash left on the bedroom's floor alongside an empty pizza box, a full trash bag and a soiled diaper.
The child was seen lying on her left side and officers noted that the exposed right side had sustained discoloration from the child's right hip to the upper right arm. The head was described as being "darkly discolored," according to court documents.
As part of the investigation, authorities utilized an infrared thermometer to record the temperature in the room where the child's body was found. The temperature in the room's ceiling came back to 108.3 degrees while another reading of the child's body read at 108.8 degrees.
Officers then proceeded to speak with Perez who reportedly said she placed the 2-year-old in the crib in the closet around 7 p.m. on Tuesday, Nov. 26. Perez also allegedly told police she had turned on a space heater in the closet and closed the closet door "nearly all the way."
Court documents state the child was not evaluated by either Perez or Hirschy until 3 p.m. the following day, despite Perez admitting that she woke up at 12:30 p.m. on Nov. 27.
An autopsy determined the child died as a result of hypothermia due to the overheating of the body, court documents said.
Authorities described the apartment as being full of trash, making it "difficult to navigate," according to court documents. Cockroaches were also reportedly observed by authorities within the apartment.
Deputies also found a 5-year-old and 3-year-old inside the residence during their investigation who were also identified as the couple's biological children. The children were brought into custody by DCS workers. Court documents said authorities on the scene determined the children were allegedly found with lice.
According to online court records, Hirschy is set to appear in a jury trial at 9:30 a.m. in Adams Circuit Court on March 7, 2025, while Perez's jury trial is scheduled for the same date at 10:45 a.m.
