MEMPHIS, Tenn. -- The jury has begun deliberating in the capital murder trial for Timothy Herrington Jr., the man accused of killing University of Mississippi student Jimmie "Jay" Lee.
The State and defense rested their cases Tuesday afternoon, and the jury is now discussing the case following closing arguments and jury instructions.
The judge instructed the jury to find Herrington guilty of either Capital Murder, First Degree Murder, Second Degree Murder, Manslaughter by Culpable Negligence, or not guilty.

Herrington could face the death penalty if convicted of 20-year-old "Jay" Lee's 2022 disappearance and murder. Lee's body has never been found.
Defense attorney Kevin Horan has from the beginning argued the State has no direct evidence that his client held Lee against his will or murdered him.
Nonetheless, the State believes they have provided "sufficient evidence" that should allow a "reasonable" juror to determine Lee is no longer alive.
