TOPEKA (KSNT) - A special prosecutor has determined there isn't enough evidence to file criminal charges against a Kansas school superintendent who was arrested earlier this year. Now the school board must decide if he can return to work. The Lyndon Police Department arrested Lyndon USD 421 Superintendent Brad Marcotte in October on suspicion of child endangerment and obstruction. He was booked into jail and released him the same day on a $2,500 bond. Following Marcotte's arrest, USD 421 announced the school board had voted to place him on administrative leave while the incident was under investigation. In the meantime, the district brought in Paul Dorathy to serve as interim superintendent. Investigators assigned Special Prosecutor Jack Hobbs to determine whether Marcotte should face criminal charges. Hobbs told 27 News after reviewing the matter, he found there was not sufficient evidence to charge Marcotte with a crime. Dorathy declined to comment until the school board has a chance to review Hobbs's decision. He said the board is set to vote at its Dec. 11 meeting whether to reinstate Marcotte as superintendent.
