Nebraska’s AG Office Prepares for Medical Marijuana Lawsuit Appeal

Nebraska Attorney General Mike Hilgers (Courtesy of Nebraska AG's Office)LINCOLN–(KFOR/Nebraska Examiner Dec. 3)–An amended cross-claim was filed last Friday by Nebraska Attorney General Mike Hilgers, on behalf of Secretary of State Bob Evnen in a lawsuit against two medical cannabis measures, which were successfully passed by Nebraska voters in November.
According to the Nebraska Examiner, the brief adds allegations of circulator fraud and widespread malfeasance to Evnen’s complaint. It’s a post-trial motion, according to Hilgers, not a formal claim filed to the State Supreme Court.
Last week, Lancaster County District Court Judge Susan Strong dismissed the complaint and ruled in favor of the ballot sponsors. She noted specific allegations were not properly before the court and later ruled the petitions fulfilled all constitutional and statutory requirements under Nebraska law.
