Serenity Towers past due on MLGW, cutoff set for Dec. 4; judge allows city to appoint a receiver for property

MEMPHIS, Tenn. — One hundred fifty Serenity Towers tenants are in jeopardy of losing electricity next week as below-freezing temperatures are expected.
Attorneys for Millennia Properties, the managers of the subsidized senior living complex, say they have “no funds currently available to make payments.” They are asking MLGW for an extension.
Millennia's attorney, Geoffrey Gaia, told Judge Patrick Dandridge on Tuesday that MLGW utilities are now past due and there is now a cut off notice of Dec. 4
“That's something that we just heard today," said Marcus Ward, the appointed special master in the case. "I don't know how close they were to it happening, but we will make sure that it doesn't happen to them, especially given the forecasted weather events that are happening next few days. ”
The city of Memphis recently stepped in and paid nearly $12,000 to fix broken elevators inside the high-rise, where most residents are seniors or disabled.
But the city’s attorney Carlissa Shaw says Memphis has no plans to foot the MLGW bill, too.

“We don't plan on the city bearing the burden of a for-profit organization anymore," she said. "That just has been done way too long in this case. And a big part about why we want receivership to be something that's possible.”
And that’s exactly what Judge Dandridge did — as of today, the city now has permission to appoint a receiver, someone who will essentially step in to take control and manage the property while legal issues are resolved.
“The city has been pushing this litigation for a number of years to make sure that these residents have the things that they need. Thankfully, I think that we are close to getting that done," Shaw said.
In the meantime, many residents are still dealing with HVAC and hot water issues.
We are told the boiler was recently turned on and that should be resolved soon.
