BAKERSFIELD, Calif. (KGET) -- A man who authorities say drove drunk in a crash Friday that killed a 12-year-old girl was accused in May of shoving and hitting his mother at her birthday party. Diego Godinez, 35, was charged with misdemeanor battery after his mother reported he shoved her to the ground and punched her in the back, according to court filings. Godinez was driving a Chevy SUV on Friday night that collided with a Honda sedan at the intersection of Hosking and South Union avenues, police said. Two passengers in the Honda, ages 11 and 12, were taken to a hospital with major injuries. The 12-year-old, identified by coroner's officials as Anabel Marie Ramirez, died about 90 minutes later. Godinez was arrested on suspicion of gross vehicular manslaughter and DUI-related offenses, police said. He was not listed in custody as of Tuesday morning. Police have said he was injured in the crash and will be booked into jail once medically cleared. In the May incident, Godinez's mother told police he'd been drinking all day and tried to fight relatives she'd invited to her birthday party. Family separated them. Most people left soon after because of his behavior, she said. The mother said she went inside where Godinez continued arguing. Godinez punched her in the lower back then shoved her down again, she told police. Fearing he'd continue to hit her, she used pepper spray on him, she told police. A Ring camera captured the shove in the driveway, according to the filings. Godinez denied shoving or hitting his mother. He told police he thought they were called because he was fighting his cousins. Court records show Godinez has multiple prior convictions, including for assault, hit and run and spousal battery.
