MEMPHIS, Tenn. -- Three of the five former Memphis Police Officers charged in Tyre Nichols' death faced a judge again on Monday morning. While in court, the judge granted former officers Tadarrius Bean, Justin Smith, and Demetrius Haley's motion to sever, separating their trails from former officer Emmitt Martin. The two state trials will both be held in April 2025. Bean, Smith, and Haley's attorneys believe that if Martin is tried with them after he has already admitted to guilt in the federal trial, then the jury will see them guilty as well in the state trial.  This comes after Bean and Smith's attorney filed a motion to sever, requesting separate trials from Martin during their last court hearing. Even though Haley was absent from that court hearing, District Attorney Steve Mulroy confirmed that his attorney had also planned to file a motion for severance. “Mr. Martin has in his prior statements has mentioned Demetrius Haley countless times and it is inappropriate frankly for them to be sitting next to each other in this courtroom,” said Michael Stengel, Haley’s attorney. They are pretending he is a co-defendant when in fact he is a cooperating witness,” said Smith’s attorney. “It keeps the gamesmanship out of it and that’s all we are asking you to do. We want a fair trial," said John Keith Perry, Bean’s attorney. Mulroy says the state agreed they would not use Martin’s past statements to incriminate the defendants.  “Ultimately it may not matter all that much because depending on what happens with the federal sentence with defendant Martin, that case may resolve and then we really are no different than where we are right now,” Mulroy said. Last month, Bean, Smith, and another former officer Haley received mixed verdicts during the federal trial. Smith and Bean were found guilty only on an obstruction charge. A complete list of the verdicts is here. Desmond Mills and Martin had already taken deals and pleaded guilty to federal charges before the trial. Mills also agreed to plead guilty to state charges. They are each now facing state criminal charges of Second-Degree Murder. They are scheduled to appear back in court on February 21, 2025.
