The plaintiff alleged that defendant surgeon breached the standard of care in his postoperative care following a bicep tendon repair. Plaintiff alleged that the surgeon transected his posterior interosseous nerve during the bicep tendon repair. Following the surgery, plaintiff alleged that the surgeon failed to identify, diagnose and treat the nerve injury within the roughly six-month window which would have allowed for the nerve to be repaired.
