Suspect charged in Overland Park sexual assault incident appears in court

OLATHE, Kan. -- One day after police arrested him, the suspect in an Overland Park sexual assault case goes before a Johnson County judge.
Gabriel Hernandez is accused of sexually assaulting an Overland Park woman in her home early Tuesday morning.
He was arrested within one day of the police department asking for the public’s help.
Hernandez went before a Johnson County judge Thursday. The Judge set his bond at $750,000.

"You have count one rape, count two aggravated criminal sodomy, count 3 aggravated criminal sodomy, count 4 aggravated burglary and count five theft,” the Johnson County judge shared Thursday afternoon in the courtroom to Hernandez.
"The first three charges that I cited are level one felonies, so the range of sentence is anywhere from 12 years up to 50 years in a penitentiary, depending on criminal history,” Johnson County District Attorney Steve Howe said.
Howe commending quick response from law enforcement with the identification and arrest.
"I commend the Overland Park Police Department, they got on this really quickly, worked really hard, along with our Johnson County Crime Lab. Those two agencies, along with some federal investigative help, were able to track down Mr. Hernandez and get him into custody,” Howe said. “We can’t stop every crime from happening, but we can make a difference in regards to how we respond to these serious types of crimes.”

Hernandez is due back in court December 5.
