FRESNO, Calif. (KSEE/KGPE) - Mobile food vendors and allies will protest outside Fresno City Hall Thursday against a proposed ordinance that will limit their operations. Cultiva la Salud is partnering with the Mobile Food Vendor Association (MVFA) to address the Fresno City Council's "Sidewalk Vending Ordinance." According to the council's agenda, this ordinance is intended to increase public and vendor safety as well as maintain the quality of neighborhoods. Several limitations and regulations address where a vendor can sell food, including cooking underneath awnings, distance to buildings or on private property. Cultiva la Salud says the "unjust" ordinance fails to consider the livelihoods of low-income food entrepreneurs and excludes vendors from policy discussions. "This ordinance unfairly codifies anti-competitive practices, imposes burdensome distance rules, proposes vague fine structures, and ID barriers, while neglecting collaborative solutions like vending districts, workshops, and small business grants," Cultiva la Salud said in a statement. Additionally, the ordinance allows the fire department or code enforcement to conduct inspections. If vendors are in violation of ordinance regulations, they will be provided a warning first before potentially facing fines of up to $500. Councilmember Miguel Arias clarified at the council meeting on Nov. 7 that fine structures were modified so vendors could be fined up to $100 for a violation following a warning. He clarifies only egregious and repeat violators will be fined up to $500. Vendors and advocates expressed their concern for the regulations and fines at that meeting, highlighting many of them make less than $100 on a good day. Vendors asked council members to consider their livelihoods and the dangers and conditions they face daily selling in the streets of Fresno. Arias said the city has already invested $1.5 million in supporting vendors by getting them cameras, carts, and more prior to the introduction of the ordinance. "The reason we need a policy is that we cannot address the repeat offenders and the problem without having a city-wide policy across the area. It is unfair to treat businesses in one part of town or in one neighborhood differently than a different neighborhood," he said. The city council decided to revisit the ordinance with revisions at the next council meeting on Thursday. The MVFA is taking to city hall Thursday afternoon at 3:30 p.m. to call for the city council to reject the Sidewalk Vending Ordinance and create "equitable policies that reflect the vital role street food vendors play in Fresno’s economy and culture."
