BAKERSFIELD, Calif. (KGET) -- They picked a fight with a guy they came across in southeast Bakersfield. He surprised them with how well he defended himself, using a tree branch to hold them at bay. Lance Burnett, 18, got fed up. He told Dylan Fermin Flores, 13, to keep an eye on the man while he went home, according to newly-released police reports. Flores, armed with a knife, agreed. Soon after, Burnett returned with a gun. The man tried to run, but they chased him and Burnett fired several times, killing him, Flores told police. Both he and Burnett are charged with murder in the shooting, which occurred last month in a large field southwest of South Washington Street and East Belle Terrace. As of Friday, the victim's name has not been released. Flores' case is being heard in juvenile court -- because he's under 16, he can't be transferred to adult court. If convicted as charged, Burnett faces a life term in prison. Flores, if convicted, could be kept in a youth facility until he turns 25. Police are familiar with Burnett -- they questioned him in March in connection with a sexual assault investigation, the reports say. He was on juvenile probation for battery, conspiracy, brandishing a weapon, criminal threats and vandalism. The shooting On Oct. 27, police were called to the field by a couple who told officers they heard bullets whizzing by their home, and, after seeing people leave the field, went to investigate and found the body. Four spent casings were recovered. Police canvassed the area for surveillance footage. They found video of the incident. It showed three teens on motorcycles and the victim. On Oct. 30, police stopped Flores and another juvenile who matched the description of two of the suspects. They were riding a mini bike and wearing face masks that matched those seen in the video. One teen -- who isn't charged -- told police he was riding with Flores and a guy on a red bike, whom he didn't know, on the day of the shooting. He said they stopped near the victim and he kept behind the other two as they tried to fight the man, according to the reports. Burnett left for a while, he said. When he returned, Burnett rode close to the victim -- and shots rang out, the teen told police. The teen refused to admit Burnett was the shooter, the reports say, only telling police neither he nor Flores fired. Flores gave a similar account of events -- and admitted to instigating the fight, according to the reports. He identified Burnett in a photo lineup as the shooter. Flores also shared with police a video he took on his cellphone. It shows the victim lying facedown in the field while Flores holds a knife and yells that they just killed him, according to the reports. Police noted Flores' statement was consistent with the surveillance video they recovered. Flores' next hearing is scheduled in early December, and Burnett is due back in court in January. Both remain in custody.
