(COLORADO SPRINGS) — Unofficial results for the two marijuana questions on the ballot have been updated, with one showing it's failing by 1% and the other looking to pass with more than a 9% difference. The latest drop of votes for El Paso County came down on Thursday night, Nov. 14, and showed that Question 300 is passing, while Ballot Question 2D is failing by a narrow margin. Question 300 asked to amend the City ordinance to allow existing medical marijuana licensees to apply to become licensed as retail/recreational marijuana businesses.  As of the latest, unofficial results, Question 300 is passing with 54.7% of the votes. Meantime, Question 2D is failing with 50.6% of voters saying no and 49.4% saying yes. Marijuana retailers, such as Levi with Terp Labs were hopeful Question 300 would pass to help stores in the area. “The medical marijuana industry in Colorado Springs hasn’t been profitable for years. Most stores were hanging on in the anticipation that hopefully, recreational marijuana would be able to come to the state,” Levi with Terp Labs told FOX21 previously. “So all of the dispensary owners that I’m aware of are hurting financially. They’ve already laid off large amounts of people. As far as I know, 90% of those are going to go out of business.” A "yes" vote on Question 300 authorizes only medical licensees to become recreational retailers, however, they must follow regulations and the Colorado Springs City Code which prohibits: Any retail/recreational marijuana business within 1,000 feet of a public or private daycare, preschool, or K-12 school. Sale or transfer of recreational marijuana to anyone under 21. Sale or transfer of recreational marijuana by any person at any public or private school, daycare, or preschool. "Today is a win for Colorado Springs voters, who chose recreational marijuana legalization over an outright ban," said Meghan Graf, spokesperson for Citizens for Responsible Marijuana Regulation. "This just put it to rest." FOX21 News reached out to the Colorado Springs Mayor's Office for comment, which said they had no comment as of Friday morning, Nov. 15.
