The Nez Perce County Prosecutor's Office is seeking the death penalty against Nicholas Umphenour, the man accused of killing someone while on the run from an Idaho prison earlier this year.As we've previously reported, Umphenour was on the run after firing shots at IDOC officers and helping inmate Skylar Meade escape. While on the run, Meade and Umphenour are suspected of committing two murders. They were formally indicted in Nez Perce County for the murder of 83-year-old James L. Mauney who was found dead near Leland along with the suspect's stolen getaway vehicle. The other victim, Gerald "Don" Henderson was found dead in his home outside of Orofino in Clearwater County. The investigation is ongoing in that case, but shackles found at the scene lead police to believe they were left by Skylar Meade.RELATED: Skylar Meade and Nicholas Umphenour indicted for north Idaho murder.Umphenour appeared in court for the first time on Thursday, and his arraignment is set for Dec. 12.
