Report clears US Park Police officers in shooting of Bijan Ghaisar; father finds it unjustified

WASHINGTON (DC News Now) -- A new report from the Department of the Interior (DOI) said that two U.S. Park Police (USPP) officers were justified in the killing of Bijan Ghaisar in 2017.
The Inspector General said officers followed all but one policy at the time.
The officers were put on paid administrative duty after the shooting in 2017 and have been on paid leave since 2020.

The department is facing a lawsuit from the officers because DOI still hasn't made a final decision on their firing.
Bijan Ghaisar's father James Ghaisar said he's disappointed but not surprised by the report.
This Sunday, Nov. 17 marks seven years since Bijan Ghaisar was shot and killed by the officers.
"The incident didn't kill him only. It killed me too. I am not the same person anymore," James Ghaisar said.
Bijan Ghaisar was rear-ended in 2017 but left the scene. He was stopped twice on the GW Parkway before driving off.
The third time he was stopped was when officers Lucas Vinyard and Alejandro Amaya fired multiple shots at him as he tried to drive away.
"They actually knew that he was a victim of the hit and run," James Ghaisar said.

This week's Inspector General report concluded the officers' pursuit and drawing their guns was consistent with department policy. However, the report said Amaya struck Bijan Ghaisar's SUV window during the second stop with his gun, and that did violate the U.S. Park Police's firearms policy.

"This is not a democracy. The way this has happened. The direction that we are going, I mean, literally with a simple mistake, you can easily get killed without any consequences to anybody," James Ghaisar said.
He said the report's release near the anniversary of his son's death is tough.
"Though I have no hope of having real justice or real changes to save other people's life. I hope at some point this would happen and we would be more kind, gentle toward each other," James Ghaisar said.
Amaya's attorneys Edward Wenger and Jonathan Fahey released a statement regarding the release of the report.
"After a thorough and independent investigation, the Inspector General confirmed what the United States District Judge found nearly three years ago, that Officers Amaya and Vineyard’s decision to use force was justified.
We don’t have any comment on the pending civil matter but hope that these findings will be considered in the pending administrative matter."

Vinyard's attorney Dan Crowley also released a statement.
"The Inspector General has completed its investigation and reached the same conclusion as everyone else who reviewed the evidence—Officer Vinyard did nothing wrong.
We won’t comment on the pending civil case, but we hope this puts an end to the administrative action. Officials at the DOI bypassed Park Police leadership to try to fire Officer Vinyard, without conducting any internal investigation. With the Inspector General’s independent report confirming that Officer Vinyard followed his training and Department policy, we hope that the DOI will do the right thing."
