ALBUQUERQUE, N.M. (KRQE) – The New Mexico Court of Appeals has upheld the conviction of the man who tried to cover up the Victoria Martens murder. Fabian Gonzales is serving a 37.5-year sentence for dismembering the ten-year-old's body in an effort to get rid of it.

Police found the charred remains in an apartment building near Irving Blvd. and Golf Course Rd. Gonzales appealed six of his seven counts, arguing there was not enough evidence to convict him. He also claimed there were problems with the jury instructions, and said convicting him on six counts was double jeopardy. The appellate court disagreed and affirmed the conviction.
