While inside the girlfriend's apartment in the Diggs Town neighborhood on Sept. 8, 2023, Davis and the girlfriend's friend began arguing. The two men continued the argument outside and Davis pulled out a gun and shot the unarmed victim before fleeing.
The bullet went through the man's hand and stomach, but he was still able to call 911 and receive medical treatment.
The girlfriend did not help police, but the victim was eventually able to identify Davis.
Norfolk Police arrested Davis at his workplace the following month. His employer found a handgun in Davis’ bag, that was left behind, and notified police of the firearm. Davis was already a felon and prohibited from possessing a firearm.
Davis agreed on Sept. 16 to plead guilty to malicious wounding and being a felon in possession of a firearm, and the Commonwealth agreed to dismiss additional charges against Davis from the same incident. There was no agreement to Davis’ sentence. Judge Jamilah D. LeCruise accepted Davis’ plea agreement and found him guilty.
On Friday, Judge LeCruise heard arguments from the prosecutor and the defense, sentenced Davis to serve five years in prison, and suspended another 10 years on the conditions that Davis comply with probation and be of uniform good behavior for an indeterminate period following his release. Davis’ active sentence was above the midpoint and below the high end of his state sentencing guidelines.
