Will Bob Lee’s accused killer testify in selfdefense at trial?
Nov 11, 2024
SAN FRANCISCO (KRON) -- There's an elephant in the courtroom in the trial for Bob Lee's accused killer.
Last week, prosecutors called on their last witness and rested their case. When the trial resumes in the San Francisco courthouse on Tuesday, Nima Momeni's defense team will call its own list of witnesses to the stand. Will Momeni testify in self defense and attempt to convince the jury that he's not a murderer?
Will defense attorneys allow Momeni, in his own words, tell his side of the story with jurors and news reporters listening?
Momeni is charged with murdering Lee by stabbing him in the heart on April 4, 2023 under San Francisco’s Bay Bridge. Lee was an executive for cryptocurrency company MobileCoin and the founder of Cash App.

When asked if Momeni will testify, defense attorney Saam Zangeneh held his cards close to his chest. "He's been wanting to tell his side of the story for a very long time. The picture that has been painted of Nima, isn't Nima. Of course he wants to testify, but as his attorneys, we are going to counsel him whether or not that's the right thing to do based on how the trial is going," Zangeneh told reporters.
Lee, 43, spent his last day alive partying with friends including Momeni’s younger sister. The sister, Khazar, testified that she was given a "date rape" drug and sexually assaulted by Lee's friend at one of the parties.
Prosecutors told jurors that Momeni was a "wannabe tough guy big brother" who plotted to kill Lee because of the tech mogul's "inappropriate" relationship with Khazar.

During opening statements on October 14, Assistant District Attorney Omid Talai told jurors, "You are sitting in court with a murderer. A coward who stabbed an unarmed man three times."
Lee and Momeni left Khazar’s apartment together on April 4 and drove in Momeni’s BMW to a street under the bridge. After the victim was stabbed, Lee left behind a blood trail and collapsed in the street alone.
Zangeneh portrayed Lee as the aggressor and claimed Momeni had to fight back. "After a 90-hour drug fueled bender, Bob Lee took a knife out of his pocket … to attack Nima. It’s terrible somebody’s dead, nobody likes that, but you have the right to defend yourself," Zangeneh said.
Legal analyst Michael Cardoza said if Momeni takes the stand, he will have to answer a tough question from prosecutors on cross-examination. If he acted in self defense, why didn't Momeni call 911? "He better have a good answer to that question," Cardoza told KRON4.

Earlier in the trial, jurors watched surveillance video from traffic cameras that recorded the BMW leaving the crime scene and driving back to Momeni's home in Emeryville just before 3 a.m.
Judge Alexandra Gordon is presiding over the trial. During jury selection, Gordon told jurors that, for each witness, they must decide whether the witness and their testimony is credible. Jurors are not allowed to discuss the case with each other until their deliberations begin.
The jury read text messages that Khazar sent to her brother hours after Lee was stabbed to death. In the texts, she demanded to know what happened to Lee. Momeni told Khazar that Lee went to a strip club.
Khazar testified on the stand for four days defending her brother's character and describing her own heavy drug use. Khazar testified, "I was under the influence (of drugs) for a week after Bob’s passing. I was crying, I was not doing well. I didn’t know what to do."
